Agreement to terms

By accessing ascendaradesign.com or engaging our systems work you agree to these Terms of Service. If you do not agree, please discontinue use of the website and contact us to discuss alternative arrangements.

Scope of systems

Ascendara Design provides strategy, design, engineering, content, and enablement systems as documented in proposals, statements of work, or email approvals.

• Deliverables, timelines, and review cadences are specified in the applicable statement of work.
• Work outside the documented scope requires written approval and may incur additional fees.
• Subcontractors may support delivery; they operate under confidentiality obligations consistent with this agreement.

Client responsibilities

Successful transformation relies on timely collaboration and accurate information.

• Provide access to stakeholders, systems, and assets required to complete the work.
• Review deliverables and supply feedback within the agreed review window.
• Ensure you have authority to share any third-party materials supplied to Ascendara.

Fees and payment

Payment terms are documented in the proposal or invoice. Unless noted otherwise, invoices are due within 21 days of issue.

• Late payments may pause project work until the account is current.
• Retainers and deposits are non-refundable because resources are reserved in advance.
• Expenses such as software, research incentives, or travel will be pre-approved and billed separately.

Intellectual property

You receive ownership of deliverables upon full payment, excluding pre-existing tools, libraries, or third-party assets used during delivery.

• Ascendara retains the right to reference non-confidential aspects of the work for portfolio or case study purposes.
• Open source, stock, or third-party assets remain subject to their original licenses.

Confidentiality

Both parties agree to protect confidential information shared during the engagement, limiting use to the purposes outlined in the project agreement.

Limitation of liability

Ascendara Design is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees paid for the specific systems giving rise to the claim.

Changes to these terms

We may update these terms to reflect process or legal changes. Significant updates will be noted on this page with a revised date.
